Secretary General criticizes mismanagement and unlawful practices in judicial and administrative sectors

Bangladesh Jamaat-e-Islami’s Secretary General and former member of the parliament Professor Mia Golam Porwar has issued the following statement on 27 August 2020 expressing deep concern over the present condition of the judicial system and the administration.

“A girl namely Disha Moni went missing on last 4 July from Deovog area of Narayanganj. Consequently, his father sued a case in Narayanganj Sadar model thana. Police also arrested 3 people terming them as suspect and took them into police remand. Police tortured them severely and compelled them to make a confessional statement under section 164 about murdering the missing girl. But 51 days after the incident that girl has been rescued as alive. Following the issuance of the case, police actually made no investigation and without being confirmed about the girl’s murder, they forced some innocent men to take the liabilities by torturing them inhumanly. Police also took a handsome amount of money from the detainees as well.

The law enforcement agencies and the entire judicial system are being controlled by the administration. Top lawyers have been making allegation repeatedly for last couple of years that, the lower courts have turned into subservient institution of the government. Confessional statement under 164 section is always controversial. Though the victim girl has been rescued as alive but 3 innocent detainees had suffered brutally for murdering her. This entire incident proved once again that confessional statement has no validity and effectiveness. Practically this controversial 164 section is being used to oppress general masses.

I am urging the concerned authorities to take punitive measures against the corrupt and dishonest police officials who were involved with this unlawful incident. I am calling upon the authority to stop the abuse of section 164 and to take effective steps to establish a transparent and fair judicial system.
